1. Acceptance of Terms
By accessing or using devShell ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service. Your continued use of the Service constitutes acceptance of these terms and any future amendments.
2. Service Description
devShell provides cloud-based development environments with optional access to third-party Large Language Model (LLM) provider endpoints, as well as integrated messaging functionality via a shared Telegram bot infrastructure. The Service is provided on an as-is, best-effort basis.
3. No Service Level Agreement (SLA)
devShell does not provide any Service Level Agreement (SLA) or Operational Level Agreement (OLA). The Service is provided on a best-effort basis only. We make no guarantees regarding uptime, availability, response times, performance, or reliability of the Service. The Service may be interrupted, suspended, or discontinued at any time without prior notice.
4. No Refund Policy
All payments made to devShell are final and non-refundable. This includes, but is not limited to, subscription fees, credits, and any other charges. By purchasing credits or subscribing to the Service, you acknowledge and agree that no refunds will be issued under any circumstances, including but not limited to service outages, dissatisfaction with the Service, account termination, or unused credits.
5. Third-Party LLM Providers
devShell integrates with various third-party Large Language Model (LLM) providers to offer AI-powered features within development environments. devShell does not warrant, guarantee, or make any representations regarding the availability, accuracy, reliability, quality, or performance of any third-party LLM provider endpoints.
Specifically, devShell:
- Does not guarantee the availability or uptime of any LLM provider endpoint
- Does not guarantee the accuracy, completeness, or usefulness of any LLM-generated output
- Does not guarantee that LLM provider endpoints will remain accessible or unchanged
- Is not responsible for any changes, deprecations, or discontinuations by LLM providers
- Is not responsible for any costs incurred through third-party LLM provider usage
- Is not liable for any harm, loss, or damages resulting from reliance on LLM-generated content
6. Telegram Bot Integration and Message Routing
The Service utilizes a shared Telegram bot infrastructure whereby devShell operates a centralized webhook endpoint (the "Bot Endpoint") that receives, processes, and routes Telegram messages on behalf of users who elect to integrate Telegram functionality with their development environments. By registering for, accessing, or otherwise utilizing the Telegram bot integration feature of the Service, you expressly acknowledge, understand, and irrevocably agree to the following:
- All Telegram messages, commands, payloads, metadata, and associated data transmitted to or from the shared Telegram bot shall pass through and be routed via devShell's servers and infrastructure (the "Routing Infrastructure")
- The Routing Infrastructure acts solely as a transient message relay and routing mechanism; devShell does not persist, store, log, archive, monitor, inspect, analyze, surveil, or otherwise retain the content, substance, or payload of any messages routed through the Bot Endpoint beyond the ephemeral duration strictly necessary to effectuate delivery and routing
- devShell expressly disclaims any and all obligation to monitor, review, or audit the content of messages transiting through the Routing Infrastructure
- You assume sole and exclusive responsibility for all content transmitted through the Telegram bot integration, including without limitation compliance with all applicable laws, regulations, and Telegram's own Terms of Service
- devShell makes no representations or warranties, express or implied, regarding the confidentiality, integrity, or security of messages during transit through the Routing Infrastructure, notwithstanding the implementation of commercially reasonable security measures
- devShell shall not be liable for any unauthorized access, interception, loss, corruption, delay, or misdelivery of messages routed through the Bot Endpoint, howsoever caused
Your use of the Telegram bot integration feature constitutes your informed, voluntary, and unequivocal consent to the routing of your Telegram communications through devShell's shared server infrastructure as described herein. If you do not consent to such routing, you must refrain from using the Telegram bot integration feature of the Service.
